2025 Rainbows United Blarney Breakfast 50/50 Raffle The 2025 Rainbows United Blarney Breakfast 50/50 Raffle is being conducted by Rainbows United, a not-for-profit charitable organization. This raffle is being conducted pursuant to the Kansas Raffle Amendment SCR 1618, to raise funds for ongoing charitable purposes. The 2025 Rainbows United Blarney Breakfast 50/50 Raffle Official Rules and Regulations (the “Official Rules”) are set forth below. By purchasing a Raffle ticket (a “Ticket”), the purchaser acknowledges that he or she is aware of, and agrees to be bound by, these Official Rules and Rainbows United’s interpretation of any such Official Rules. Rainbows United shall be responsible for interpreting and applying the Official Rules. Rainbows United’s interpretation and application of such rules shall be final. Eligibility 2025 Rainbows United Blarney Breakfast 50/50 Raffle is open to U.S. residents 18 years of age or older at the time of purchase. All federal, state, and local laws and regulations apply. The Raffle is void where prohibited by law. Tickets Raffle tickets will be available beginning February 24, 2025. Ticket prices are: $5.00 for 1 ticket $10.00 for 10 tickets $20.00 for 75 tickets $50.00 for 200 tickets $100.00 for 500 tickets Only one Eligible Ticket Purchaser (as defined above in the “Eligibility” section of these Rules) may purchase a ticket. This means, (a) one name per ticket and (b) one purchaser per transaction. If a ticket names more than one person as a Ticket Holder and that ticket is a winning ticket, then Rainbows United will (a) deem the person named first on the ticket as the Ticket Holder, (b) declare the first person named on the ticket as the winner, and (c) award the prize to the first person named on the ticket.
All raffle ticket sales are final. No refunds or exchanges will be issued by Rainbows United. Purchasing Tickets Tickets will be available online through Handbid until 11:59:59 PM CST on March 17, 2025. Prize Drawing One random drawing will be held on March 18, 2025 at 9:00 a.m. and winner will announced through official Rainbows United Social media channels. Winner will be notified according to the contact information provided to Rainbows United at the time of ticket purchase. Ticket purchasers are responsible for notifying Rainbows United of any changes to their contact information. Rainbows United will make diligent efforts to contact winner, however, if prize is not claimed or winner cannot be located within 30 days of the original drawing, winner will lose their right to the prize and Rainbows United will draw an alternate winner from valid tickets available at the time of the original drawing. Estimated Odds of Winning Actual odds of winning are dependent upon the total number of eligible entries.
Prize One (1) grand prize of fifty percent (50%) of the net proceeds (gross proceeds less direct costs) from the cumulative sale of Raffle tickets during the Raffle Period will be awarded for the Raffle (the “Grand Prize”). Direct costs include a 3.5% + $.30 fee per transaction from the online platform Stripe plus any applicable taxes. Sponsor will withhold twenty-four percent (24%) from the winnings if the amount of the prize is greater than $5,000 and will report this amount to the IRS on Form W-2G.
No substitutions, reassignments, or transfers of prize permitted. Winner is solely responsible for reporting and paying all applicable income taxes related to the prize and paying any expenses associated with the prize which are not specifically provided for in the official rules. Winner must provide Rainbows United with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded. Winner is responsible for picking up the prize from Wichita, Kansas. Non-Deductibility of Ticket Purchase The IRS has taken the position that amounts paid for chances in raffles, lotteries or similar drawings for valuable prizes are not gifts, and consequently, the purchase of a Ticket does not qualify as a deductible charitable contribution. Terms and Conditions The Raffle is subject to these Official Rules. These Official Rules cannot be changed by any oral statement made by any employee, consultant or agent acting on behalf of Rainbows United. By entering this Raffle, entrants accept and agree: (1) to be bound by these Official Rules and the decisions of Rainbows United which shall be final and binding; (2) waive any right to claim ambiguity in the Raffle or these Official Rules; and (3) that Rainbows United may use the entrant’s name, photograph, likeness, statements, biographical information, voice and city and state address for promotional or advertising purposes in connection with the Raffle on a worldwide basis and in all forms of media, now or hereafter known, in perpetuity, without review, permission or further compensation, except where prohibited by law. LOSSES, DAMAGES, RIGHTS, CLAIMS AND ACTIONS OF ANY KIND ARISING FROM, IN CONNECTION WITH, OR AS A RESULT OF PARTICIPATING IN THE RAFFLE OR THE WINNER’S ACCEPTANCE OR USE OF ANY PRIZE. A RAFFLE ENTRANT’S SOLE AND EXCLUSIVE REMEDY FOR ANY CLAIM AGAINST Rainbows United ARISING OUT OF THE SALE OF TICKETS OR THE CONDUCT OF THE RAFFLE SHALL BE LIMITED TO THE RETURN OF THE PURCHASE PRICE PAID FOR HIS OR HER TICKET(S). IN NO EVENT SHALL Rainbows United, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR REPRESENTATIVES BE LIABLE TO ANY PARTY FOR ANY LOSS OR INJURIES TO EARNINGS, PROFITS OR GOODWILL, OR FOR ANY INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES OF ANY PERSON OR ENTITY WHETHER ARISING IN CONTRACT, TORT OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
